Limitation Periods for Labour Disputes under Article 268 of the Romanian Labour Code

This paper analyses the limitation periods under art 268 Romanian Labour Code and argues that their application increasingly turns on how digital communication is treated as means of valid legal notification. Drawing on recent case law, including a 2024 ruling accepting WhatsApp as a valid channel for triggering the appeal period against dismissal, it argues that courts are shifting the test from communication medium to proof of effective notification. The paper also signals four instances of legislative duplication or gap within art 268 and its interaction with the Civil Code’s general rules of prescription, proposing targeted de lege ferenda corrections.
